We are of the considered opinion that the Suit filed by the plaintiff for declaration and injunction is barred under Article D 363 of the Constitution of India and the plaintiff is not entitled for any relief under Section 158(2) of the Madhya Pradesh Land Revenue Code claiming the rights of Bhumiswami.
