We are of the opinion that the judgment and order dated 11.8.2000 passed by the learned Single Judge which has been upheld by the Division Bench by its order dated 5.9.2000 F does not lay down the law correctly and the judgment and order dated 13.11.2000 passed by a Division Bench of the .Lucknow Bench of the Allahabad High Court in Writ Petition No. l 093 (S/B) of 1999 lays down the law correctly.
