We are of the view that a Customs Officer is under the Act of 1962 not a police officer within the meaning of s. 25 of the Evidence Act and the statements made before him by a person who is arrested or against whom an inquiry is made are not covered by s. 25 of the Indian Evidence Act.

Sea Customs Act (8 of 1878), and Customs Act (52 of 1962)-Cus toms Officer-If police officer within the meaning of s. 25 of the Evi dence Act (1 of 1872). The accused were charged with some offences under s. 120- Indian Penal Code read with s. 167(81) of the Sea Customs Act, 1878, s.
