In brief
The appellant took a commercial vehicle loan of Rs.10,40,080.75 from Cholamandalam Investment and Finance Company in March 2019 for his Tata SFC 407 truck, secured by hypothecation, repayable in 75 instalments, with a supplementary loan in June 2021. He defaulted repeatedly; the vehicle was once repossessed in June 2022 and released on part payment of Rs.86,726, after which he defaulted again. On 09.04.2023, at about 1:00 a.m., four unidentified persons broke the vehicle's steering lock at a godown and drove it away; the appellant lodged a lost article report and e-FIR believing it stolen, and only learnt on 30.09.2023, through the Company's legal notice, that the Company had repossessed the vehicle and sold it on 31.08.2023 for Rs.4,50,000, claiming a further Rs.1,25,571.…
