The Kishan Chand Foundation Trust, claiming title to about 4678 sq. m. in Gaganmahal Village, Hyderabad under a 1968 sale deed, was served notice under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905 and later an order under Section 6 directing delivery of possession. Its civil suit was dismissed for want of pecuniary jurisdiction and its appeal for non-prosecution; a Single Judge quashed the Section 6 and 7 proceedings, but a Division Bench set that aside on 07.09.2022, holding that a writ court cannot record findings on possession or title where facts are seriously disputed and that statutory appeal and revision remedies existed.…
