In view of the aforesaid discussion, this Court holds that although the claim of juvenility is statutorily recognizable, the present case stands on a different footing as the matter has attained finality up to the Hon'ble apex Court.

In September 2004 the appellant, his parents, brother and brother-in-law were charged under sections 302, 304B and 201 read with 34 IPC for the dowry death of Bhuri and her infant daughter, whose bodies were found on a railway track and were forcibly lifted and cremated by the accused without informing the police or the victim's relatives. At trial the family witnesses and independent witnesses did not support the dowry or murder allegations and were declared hostile; the accused were acquitted of murder and dowry death but convicted under section 201 Part II IPC and sentenced to three years' RI.…
