The appellant husband married Respondent No. 2 on 7 July 2014; relations soured and on 13 May 2020 the wife left the matrimonial home with their child. On 5 November 2020 she applied under Section 125 CrPC for maintenance and interim maintenance before the Special Additional Chief Judicial Magistrate, Udaipur. The husband filed an application under Section 125(4) CrPC asserting that the wife was living in adultery with a named person and was therefore disentitled to interim or final maintenance, relying on a large volume of photographs, videos and other electronic material (about 237 photographs and 92 videos), apparently obtained from a third party such as a private investigator.…
