What the Court ordered
For the aforesaid reasons, the present appeal is allowed. Accordingly, the impugned judgment and order dated 01.04.2025 passed by the High Court of Judicature for Rajasthan at Jodhpur in S.B. Criminal Revision Petition No. 133 of 2024 is hereby set aside and the order dated 28.11.2023 passed by the Court of Additional District and Sessions Judge at Merta in Session Case No. 43 of 2021 framing charge, inter alia, under Section 307 of the IPC against respondent No. 2 is restored.

In brief
On 26.11.2020, while the appellant was pruning Khejri trees in his agricultural field at Village Polas, Nagaur, respondent No. 2 along with family members drove a tractor at high speed into the field and repeatedly steered it towards the appellant and his family in an attempt to run them over, striking the appellant's mother on the waist and felling her. Respondent No. 2 and the co-accused then assaulted the appellant and his father with sharp-edged agricultural implements (kashi/axes); the appellant suffered a bone-deep incised wound of 7cm x 3cm on the left arm and his father suffered two incised wounds (one bone-deep on the wrist, one muscle-deep on the forearm), while the mother sustained an abrasion.…
