In view of the aforesaid discussion, we are of the view that the prosecution has failed to prove the case against the appellants- accused persons beyond reasonable doubt, despite which the Trial Court has recorded the judgment and order of conviction and order of sentence, which has been confirmed by the High Court vide the impugned judgment.
