In the light of the above, the impugned judgment is set aside. The Appeal is accordingly allowed with a direction that the Appellant be enlarged on bail on the appropriate terms and conditions to be fixed by the Special Court.

The appellant, alleged to be an active member of the Popular Front of India (PFI), was arrested on 12.07.2022 along with co-accused Md. Jalaluddin after a raid on 11.07.2022 at Ahmad Palace, Phulwari Sharif, Patna, where the appellant had taken the first floor on rent from Jalaluddin. The prosecution alleged he organised PFI meetings/training on 29 May and 6-7 July 2022 at those premises, participated in and encouraged provocative sloganeering at a protest on 09.06.2022 over remarks by Nupur Sharma, collected Zakat for PFI, and was linked to ex-SIMI members; a document titled 'India 2047 towards rule of Islam in India' was said to be seized, though the seizure memo showed recovery from the second floor which was never in his possession.…
