For the reasons recorded above, it can be safely concluded that Article 20(1) of the Constitution has no applicability either to the validity or invalidity of Section 6A of the DSPE Act.

Issues for consideration: Section 6A(1) of the Delhi Special Police Establish ment Act, 1946 (DSPE Act) required approval of the Central Governm ent to conduct inquiry or investigation into any off ence alleged to have been committed by senior Government offi cers under the Prevention of Corruption Act, 1988; and provided a kind of immunity to such offi cers.
