In view of the above, we are of the opinion that it is necessary to interfere with the findings of the Courts below convicting A-3 (appellant in Criminal Appeal No. 574 of 2012) for the offence under Sections 304B and 201 read with Section 34, IPC. The said appeal filed by A-3 is accordingly allow ed.
