Landlord-Tenant Dispute: Rent control legislation – Protection under – Maintainability of suit for possession – In the ins tant case, by virtue of a Will, the testator bequeathed his proper ty to his son subject to a right of residence to his widowed daug hter – The daughter was given a life interest in the suit property a nd right to spend income from rent on herself – However, as per the Will, she was not entitled to transfer, mortgage, sell or gif t the property – Whether with the death of the widowed daughter, the tenant would become a trespasser on the property and liable to be r emoved
