What the Court ordered
For the aforesaid reasons, we come to a conclusion that the COI 27 failed to adhere to the procedure laid down in Army Rule 180; it’s findings are based on the material which could not be relied upon without its formal proof (like the allegations in the complaint or the report of discreet inquiry); and there is a violation of principle of natural justice.
