In view of the above, we allow this appeal and set aside the impugned judgment and order and decree passed by the High Court and instead, restore the judgment and decree passed by the Tr ial Court as affirmed by the First Appellate Court. 30.Accordingly, this appeal is allowed with no order as to costs.
