For the reasons aforesaid, we set aside the impugned A common judgment dated 2nd August, 2011 passed by the High Court in RSA Nos.3127 and 5214 of 2003 etc. and uphold the respective judgment and decree passed by the Trial Court as affirmed by the First Appellate Court in the case of the plaintiffs- appellants.
