For the reasons aforesaid, we set aside the impugned judgment dated 25th November, 2009 passed by the High Court D of Judicature at Bombay in Civil Revision Application No.272 of 2009, the judgment dated 15th January, 2009 passed by the First Appellate Court and judgment and decree dated 9th June, 2005 passed by the Trial Court.
