What the Court ordered

In view of the aforesaid discussion based on the existing facts and circumstances, we deem it just and appropriate to set aside the imflugned order passed by the Special Judge refusing to accept the closure report dated E 18.05.2004 and consequently the judgment and order of the High Court by which the order of the Special Judge was upheld, also stands quashed and set aside.
