In the result, we allow this appeal in part and to the extent that while setting aside the conviction of the appellant for the offence of murder under Section 302 of the IPC, we convict him for culpable homicide not amounting to murder punishable under Section 304 (I) of the IPC and sentence him G to undergo imprisonment for a period of eight years.
