For the foregoing reasons the appeal succeeds, the judgment dated June 27, 2008 rendered by the Division Bench of High Court of Judicature at Patna in CWJC No. 6578 of 1990, directing the present appellant to consider the case of E respondent No.1 for promotion as also consequential benefits, is hereby set aside.
