What the Court ordered
We are of the considered view that the offence of the appellant could be altered from Section 302 to Section C 304 Part II of the IPC. Consequently, we hold the appellant guilty of offence under Section 304 Part II and award him rigorous imprisonment for a period of 10 years with fine of Rs. 20,000/ -. In default of payment of fine the accused shall undergo rigorous imprisonment for a period of six months.
