In view of the above discussion arid conclusion, the common impugned judgment and order dated 27.03.2008 of the Bombay High Court in W.P. (l) No. 2714 of 2007 and P.l.L. No. 72 of 2007 are set aside. Consequently, the appeals are allowed. No costs.
