Goods Tariff Rules, Part IA-Respondent's suit against Appellant for recovery of demurrage charged by railways for failure to unload wagons in time decreed by trial court-High Court in appeal maintaining decree but striking down Part 1A of the Tariff Rules as ultra vires-Held, in the absence of any pleading to the effect that the rules were ultra vires, High Court could not decide that question-Practice and Procedure. The Respondent's suit for recovery of a sum of Rs. 2,333.61 charged as demurrage by the Railway Administration
