We are of the view that the High F Court was in error in holding that the lower appellate court was obliged to take into account the subsequent events regarding the purchase of alternative accommodation by the appellant and in setting aside the Judg ment of the Additional District Judge and remanding the matter for reconsideration to the said Court.
