What the Court ordered

In the result, while we largely agree with the view expressed by the Division Bench, we modify the order of the Division Bench of the High Court to the aforementioned limited extent regarding the procedure to be followed by the Election Commission in reaching a decision and com municating its opinion to the Governor to enable the latter to decide the issue in accordance with the opinion.
