In brief

The respondent filed a private complaint on 13 June 1983 alleging that the appellants had conspired to fabricate an agreement dated 26 July 1978, forging the signature of Smt. Dalip Kaur, and had used it to claim retention of possession of the remaining part of a house. The Magistrate at Amritsar examined witnesses under Section 202 CrPC and on 27 September 1983 ordered process to issue against the appellants. Thereafter the appellants filed a civil suit for an injunction restraining Dalip Kaur from interfering with their possession, and the original agreement was filed in the civil court on 9 February 1984.…
