In the result, we allow this appeal, set aside the judgment of the Division Bench of the High Court in L.P.A. No. 70 of 1979 and restore the orders of the Revenue Assistant, affirmed by the Financial Commissioner and the learned Single Judge of the High Court with costs, which we B quantify as Rs. 20,.
