In the result, we allow this appeal, set aside the order of I he Appel late Authority ·dated 13.9.1991 as well as the orders of the BIFR dated 15.2.1991 and 23.5.1991 and remand the matter to the BIFR for passing a fresh order in accordance with law and in the light of the observations made above.
