We are of the view that it is not possible to hold that section 22-A(3) is applicable to every establishment used or in lended to be used for maintaining supplies and services essential to the community even though the State Government has not declared in a notification published in the Official Gazette that it is of the opinioa c tbat the establishment satisfied the qualification referred to in sub section (1).
