What the Court ordered
We are of the view that it is not competent to the landlord to apply for fixation of fair rent under s. 4, sub-s. (1) during the subsi stence of the contractual tenancy, we set aside the decision of the High Court of Tamil Nadu which has taken the view that the Con troller has jurisdiction to entertain the application of the respondents and allow Civil Appeal No. 50 of 1968.
