We are of the opinion that, in the particular cir cumstances of this case, there was justification for the non-exami nation of Laddan Khan, Baboon Khan, Ibne Hasan and Munnan Khan. • From the evidence of the investigating officer, P.W. 8, it is seen that the statements were recorded by the police from the above persons on the morning of October 17. 1967.
