We hold that the judgment and decree of the High Court of Madhya Pradesh dated September 7, 1965 in Second Appeal no. 275 of 1962 should be set aside and the judgment and decree of the Additional District Judge, Indore dated April 21, J 962 in First Appeal No. 26 of 1961 should be restored.
