We hold that the judgment of the Gujarat High Court in· Second Appeals Nos. 33 and 34 of 1964 L8 Sup Cl/69-10 446 SUPREME COURT REPORTS [1969] 3 s.c.R. dated 4th July, 1964 and of the District Judge of Bhavnagar dated 12th October, 1963 should be set aside and the judgment and decree of the Civil Judge (Junior Division) at Sihor dated 31st March, 1960 should be restored.
