We hold that this appeal should be· allowed, the judgment of t!te Mysore High Court dated December 5, 1960 in R.A. no. 81 of 1956 should be set aside and that of the District Judge, Mysore dated October 31, 1955 in 0.S. no. 34 of 1950-51 should be restored.
